Reclaim
credit
Card
Charges
Thousands
of
bank
customers
have
been
successful
in
winning
back
penalty
charges
from
their
bank,
but
card
customers
have
been
slower
to
act.
However,
it
is
possible
to
win
back
your
card
charges
using
similar
tactics
that
bank
customers
used
to
reclaim
their
penalty
fees.
The
principles
for
challenging
both
charges
are
the
same
–
there
is
a
legal
difference
between
charges
that
can
be
imposed
for
breach
of
contract
and
penalty
charges.
For
the
moment
banks
have
been
given
permission
to
put
bank
charges
reclaim
cases
on
hold,
(although
meant
are
still
making
substantial
refunds)
while
a
test
case
seeks
to
prove
whether
unauthorised
overdraft
charges
are
illegal.
However,
the
waiver
issued
by
the
FSA for
dealing
with
cases
only
applies
to,
'providers
of
current
accounts
with
overdraft
facilities'.
Not
credit
card
issuers.

This
means
that
those
who
have
been
hit
by
unfair
credit
card
charges
can
continue
to
complain
and
if
the
firm
refuses
to
deal
with
the
case,
or
fails
to
do
so
satisfactorily,
they
may
take
the
matter
to
the
Financial
Ombudsman
or
the
courts.
With
the
right
representation
reclaiming
credit
card
charges
is
very
simple.
The
legal
argument
on
unfair
charges
is
based
on
contract
law
saying
that
if
you
breach
a
contract,
for
example
by
late
payment,
then
the
credit
card
company
can
charge
you
and
the
courts
enforce
payment,
but
the
sum
must
reflect
the
cost
incurred
by
the
bank
and
not
be
punitive.
If
the
credit
card
company
argues
that
the
charge
is
for
a
service,
it
is
possible
to
argue
that
under
a
separate
act
the
charge
must
be
reasonable.
The
Office
of
Fair
Trading
strengthened
credit
card
customers
arguments
when
it
ruled
last
year,
that
card
companies
shouldn't
charge
more
than
£12
for
default
charges,
and
would
have
to
provide
substantial
evidence
if
they
did.
This
is
where
things
get
interesting
for
you,
the
paying
customer.
Credit
Card
Companies
have
historically
charged
much
more
than
£12,
in
fact
some
have
been
known
to
charge
£25
to
£36
and
this
in
some
cases
where
minimum
payments
were
only
£5
and
the
payment
was
only
a
matter
of
days
late.

I
can
testify
personally
to
the
above,
I
had
a
balance
of
57p
on
a
card
which
I
thought
I
had
paid
the
full
balance
off,
stupidly
I
did
not
read
the
next
statement
as
I
had
not
spent
on
the
card,
the
next
month
I
re
spent
on
this
credit
card
looked
at
the
statement
and
yes
you
guessed
it
the
credit
card
company
had
made
a
charge
of
£27.
Needless
to
say
the
£27
has
now
been
refunded.
This
just
shows
how
easy
it
is
to
fall
foul
of
excessive
charges.
